Anambra APC Fires Back at Tony Uche, Says He Misrepresented Federal High Court Proceedings

The Anambra State chapter of the All Progressives Congress (APC) has faulted a statement credited to Comrade Tony Uche, describing it as a gross misrepresentation of the proceedings before the Federal High Court Abuja.
In a statement issued by the Anambra State APC Elders Council, the party said it would ordinarily have ignored Uche’s remarks but deemed it necessary to set the record straight and correct what it described as his misleading account of the court proceedings held on Monday.
The council stated that recent public comments by Comrade Tony Uche made it imperative to present the true position of events to members of the APC in Anambra State and the general public.
According to the council, although it would normally refrain from responding to such statements, misinformation at a time like this is capable of creating unnecessary confusion within the party, and remaining silent would amount to a disservice to its members.
It stressed that the purpose of the statement was not to engage in needless public exchanges but to present the facts as they emerged from the proceedings before the Federal High Court Abuja and to reassure party faithful that the rule of law and the constitution of the APC remain paramount.
“The most significant development occurred during proceedings before Court 5 of the Federal High Court, Abuja, presided over by Hon. Justice Umar. Counsel representing the All Progressives Congress, Barr. Douglas, sought, among other reliefs, an order setting aside the judgment delivered on June 24 and an order staying its execution,” the statement said.
According to the council, the court granted a Stay of Execution, thereby suspending the enforceability of the earlier judgment pending the determination of the applications before it.
It further stated that, based on its understanding of the proceedings, parties relying on the earlier judgment were directed not to continue presenting themselves as the executive leadership of the APC in Anambra State while the matter remains before the court.
“This development is of fundamental importance. A stay of execution preserves the status quo pending the determination of the substantive issues before the court. Consequently, any reliance on the earlier judgment as authority for assuming control of party structures or exercising executive powers is now subject to the effect of the court’s stay.
“It is equally important to recall that the suit which produced the June 24 judgment was instituted against the National Chairman of the APC and the All Progressives Congress as parties,” the statement added.
The council further noted that the Senator Emmanuel Anosike-led State Executive Committee was not joined as a party to the suit.
It maintained that, beyond the present litigation, the legal position regarding the leadership of political parties has long been settled.
According to the council, the Supreme Court has consistently held that issues relating to party leadership and internal administration are primarily internal affairs of political parties, except where statutes expressly provide otherwise.
It added that the recognition of party officers remains fundamentally the responsibility of the party acting through its constitutionally recognised organs.
The council also disclosed that separate applications were filed before the same court on behalf of other defendants seeking to set aside the June 24 judgment on different legal grounds.
According to the statement, the applications challenged the processes leading to the earlier judgment and raised issues concerning documents presented before the court.
“Those matters remain pending judicial determination, and it is appropriate that all parties allow the court to determine them without prejudgment,” the council stated.
It further argued that the granting of the Stay of Execution has implications for any enforcement measures previously undertaken on the strength of the June 24 judgment.
“Until the pending applications are determined, restraint, respect for the judicial process, and adherence to lawful procedures are expected of all concerned.
“As members await the Certified True Copies of the court’s orders and the relevant processes, they are advised to rely only on verified information rather than politically motivated interpretations circulating on social media and other unofficial platforms.
“Our party has consistently maintained that disputes should be resolved through lawful institutional mechanisms rather than through confrontation or actions capable of undermining party unity. Every APC member has a responsibility to protect the image and integrity of our party.”
The council also referred to recent interventions by leaders of the party, saying they reinforce the need for reconciliation.
“During the inaugural meeting of the Five-Man Fact-Finding Committee, the National Vice Chairman (South East), Dr. Ben Nwoye, reportedly emphasised that the Anambra chapter should move beyond prolonged litigation and embrace reconciliation through the party’s internal conflict resolution mechanisms.
“That remains the most responsible path towards rebuilding confidence and strengthening the APC in Anambra State. Members should therefore remain calm, law-abiding and focused on the larger objective of repositioning our party ahead of future political engagements. Temporary disagreements should never eclipse our collective commitment to building a united, disciplined and formidable APC.”it stated.
The council stated that the authentic leadership of the party remains committed to protecting the interests of every member, strengthening its structures across the 326 wards and 21 local government areas, and preparing the APC for greater electoral success.
It urged party faithful to disregard sensational narratives designed to create confusion within the party.
According to the council, the judicial process is still ongoing, the party leadership remains actively engaged with the relevant institutions, and it is confident that truth, due process and justice will ultimately prevail.
“Our appeal is simple: let us place the unity, stability and future of the All Progressives Congress above personal interests. Anambra APC is bigger than any individual, and together we shall emerge stronger,” the statement added.
